Hennepin County has received several inquiries as to whether private parties, such as Charter and Private Schools, may be beneficiaries of Hennepin Youth Sports Program Grants secured on their behalf by a Local Unit of Government (LGU). The County Board resolution establishing the grant program does not require a project to be owned by a LGU, be on public property, and does not necessarily require a LGU to guarantee operation. The resolution does however require that the applicant be a LGU.
Therefore, in cases where a Local Unit of Government (LGU) wishes to represent a Private Land Owner (Owner) in the application for a Hennepin Youth Sports Program Grant, the LGU shall execute, with the Owner, a covenant to run with the land.
The covenant will be constructed by the LGU, shall be subject to the review of the Hennepin County Attorney’s Office, and must include the following elements:
